Article 115 Debate Summary
The debate in the assembly was based on this amendment. The amendment allowed the appropriation of funds for supplementary, additional and additional grants from the Consolidated Fund of India. One member was not convinced by this amendment, as he believed that such grants could be misused by the executive. Instead he proposed that supplementary, additional or additional funds could be given only with the approval of both houses of Parliament.
The chairman of the drafting committee defended the amendment: such grants were necessary for the smooth functioning of the executive, especially in emergency situations. Another member argued that this amendment was inconsistent with the draft Article 94(3) (Article 114), which held that no money could be withdrawn from the Consolidated Fund of India except by appropriation made by law. Therefore, withdrawal of any money from the Fund under Draft Article 95 would be in violation of both the Constitution and the Appropriation Act concerned.
The Chairman of the Drafting Committee noted that Draft Article 95 authorized the President to present estimates of expenditure before Parliament, where necessary, except in the circumstances envisaged by Draft Article 94. He further proposed the creation of a Contingency Fund from the Consolidated Fund. of India. Contingency fund can be utilized by the executive in case of emergency without violating the Appropriation Act. The Assembly accepted the amendment of the Drafting Committee and adopted the draft article on 10 June 1949.
