Article 130 Debate Summary
On 27 May 1949, there was a debate on the insertion of the draft Article 108-A (Article 130). It said that the Supreme Court would sit in Delhi, with the Chief Justice having the power to change it. The chairman of the drafting committee justified the need to specify Delhi as the seat, and said it was necessary for all courts to have a defined seat so that litigants would know where to go to court.
Furthermore, since Delhi was the capital during the debate, it was the most suitable city to be the seat of the Supreme Court; If the capital was changed in future, the language of the draft article was flexible enough to allow the seat of the Supreme Court to be changed without constitutional amendment. One member moved two separate amendments (here and here) to clarify the meaning of the draft article.
He argued that the language of the clause was ambiguous, and could be interpreted to exclude Delhi from the list of ‘other place or places’ chosen by the Chief Justice. Therefore, if the Chief Justice decides to create a Circuit Court due to the increase in the workload of the Supreme Court, he will be barred from doing so by the language of the draft article.
In response, a member stated that the language of the draft article was clear enough, and that amendment by the member was unnecessarily complicated. The amendment proposed by the Chairman of the Drafting Committee was accepted by the House, while the other amendments were withdrawn by the proposed member. The amended draft article was adopted on 27 May 1949.
