Article 156 Debate Summary
Draft Article 132 (Article 156) was debated on 31 May 1949. It fixed the term of office for the governor. The chairman of the drafting committee introduced an amendment to completely change the draft article to allow the governor to serve on the president’s offerings. One member argued that this would affect the independence of the Governor and if the Governor could remove him, he would make him a ‘president’s creature’.
Another member replied that since the Assembly had decided that the Governor would be appointed by the President, the proposed amendment was necessary as the President should be empowered to remove his appointment. A member proposed several changes to the draft article, so that the governor could be impeached “guilty of treason, or any offense against the safety, security or integrity of the Union” or “by cause physical or mental”. Incapacity duly certified, or if found guilty of bribery or corruption, or as provided in Article 137.
The Chairman of the Drafting Committee replied that it was unnecessary to limit the grounds to the removal of the grounds expressly stated in the Constitution. The amendment proposed by the Chairman of the Drafting Committee was accepted by the Assembly. The amended draft article was adopted on 31 May 1949.
