Article 174 – Sessions of the State Legislature, prorogation and dissolution.
(1) The Governor shall from time to time summon the House or each House of the Legislature of the State to meet at such time and place as he thinks fit, but six months shall not intervene between its last sitting in one session and the date appointed for its first sitting in the next session.
(2) The Governor may from time to time
(a) Prorogue the House or either House;
(b) dissolve the Legislative Assembly.

Draft Article 153 (Article 174) was debated on 2 June 1949. In this, the rules related to the sessions of the state legislatures were laid down. A member proposed an amendment to clause (2) (c), allowing the Governor to dissolve the Legislative Assembly only if he is satisfied that the administration is failing and the ministry has become unstable.

He argued that if the Constitution does not enumerate the circumstances under which a House can be dissolved, there is a possibility that the Governor can dissolve it for political reasons. It was rejected by the Assembly with little debate. The chairman of the drafting committee introduced an amendment to remove clause (3) altogether, as it was ‘inconsistent with the constitutional governor’s plan’. This was accepted by the assembly. The amended draft article was adopted on 2 June 1949.
