Article 192 Of Indian Constitution In English
Article 192 – Decision on questions as to disqualifications of members.
(1) If any question arises as to whether a member of a House of the Legislature of a State has become subject to any of the disqualifications mentioned in clause ( 1 ) of Article 191, the question shall be referred for the decision of the Governor and his decision shall be final.
(2) Before giving any decision on any such question, the Governor shall obtain the opinion of the Election Commission and shall act according to such opinion.

Article 192 Debate Summary
Draft Article 167A (Article 192) was debated on 14 June 1949. It authorized the Governor to take a final decision on the disqualification of a member subject to the opinion of the Election Commission. The draft article was not included in the Draft Constitution, 1948. A member of the drafting committee proposed the inclusion of draft Article 167A, which authorized the governor to act on the recommendation of the Election Commission to take a final decision on disqualification.
A member supported this amendment saying that it would be unfair for the Speaker to be in dispute with any member because of his involvement in any inquiry. The Chairman of the Drafting Committee also favored electing the Governor as the final authority on disqualification, but pointed out that some grounds of disqualification under the draft Article 167 (Article 191) were outside the purview of the Election Commission. To address this issue, he proposed the inclusion of the following as draft Article 167A:
‘167-A. (1) If any question arises as to whether a member of either House of the Legislature of a State has become subject to any of the disqualifications referred to in clause (1) of the preceding article, the question shall be referred for decision. The Governor and his decision will be final.
(2) Before giving any decision on any such question, the Governor shall obtain the opinion of the Election Commission and act in accordance with that opinion.’ This amendment was accepted without any debate. The draft Article 167A was adopted on 14 June 1949.
