Article 301 Debate Summary
The draft Article 274A (Article 301, Constitution of India 1950) was not included in the draft Constitution 1948. The discussion on this draft article ended on 15 June 1949 and finally took place on 8 September 1949. The chairman of the drafting committee proposed adding one. The new part XA of the constitution which contains the draft Article 274A. Draft Article 274A is the first in a series of articles that discusses trade, commerce and intercourse within the territory of India. It provides that trade, commerce and intercourse shall be free throughout India, subject to the other provisions in Part XA.
The chairman of the drafting committee introduced this new part to bring together the various provisions on trade and commerce, which were scattered in the draft constitution at one place. A member proposed to amend the draft Article 274A, which said that the freedom to engage in trade, commerce and intercourse throughout India should be subject to the provisions laid down in the Constitution rather than just Part XA. The assembly rejected this amendment.
Some members were concerned that the right to conduct trade and commerce freely throughout India was initially guaranteed as a justified fundamental right under Draft Article 16, which could be diluted in Draft Article 274A. There was – there were more restrictions. Some other members favored the inclusion of Part XA to ensure that all the provisions on trade and commerce were codified in one place. After substantial debate, the draft Article 274A was adopted on 8 September 1949.
