Article 307 Debate Summary

Draft Article 274E (Article 307 of Article 1950 of the Constitution of India) was not included in the draft Constitution 1948. It was introduced by the Chairman of the Drafting Committee on 8 September 1949 as a part of a series of articles under Part XA, which dealt with the provisions. On trade and commerce in India. The draft Article 274E empowered the Parliament to appoint an authority to give effect to the provisions of Part XA.

The various articles under Part XA were controversial as they initially restricted the freedom of trade and commerce guaranteed under the draft Article 16 and hence the right to enforce it was not accepted by all the members. A member argued that Article 274E should be removed altogether. Instead another member proposed to add a provision after this draft article – which said that any person can approach the Supreme Court for enforcement of his right to trade or commerce.

These suggestions were made to prevent the Parliament or the State Legislatures from making such laws which provide for freedom of movement under the draft Article 13 (Article 19 of 1950 of the Constitution of India) or the freedom of conduct of trade and commerce under the draft Article 16. were inconsistent with. The Assembly rejected the proposed amendment and the draft Article 274E was adopted on the same day.
