Article 319 Of Indian Constitution In English

Article 319 – Prohibition as to the holding of offices by members of Commission on ceasing to be such members.
On ceasing to hold office.
(a) the Chairman of the Union Public Service Commission shall be ineligible for further employment either under the Government of India or under the Government of a State;
(b) the Chairman of a State Public Service Commission shall be eligible for appointment as the Chairman or any other member of the Union Public Service Commission or as the Chairman of any other State Public Service Commission, but not for any other employment either under the Government of India or under the Government of a State;
(c) a member other than the Chairman of th Union Public Service Commission shall be eligible for appointment as the Chairman of the Union Public Service commission or as the Chairman of a State Public Service Commission, but not for any other employment either under the Government of India or under the Government of a State;
(d) a member other than the Chairman of a State Public Service Commission shall be eligible for appointment as the Chairman or any other member of the Union Public Service Commission or as the Chairman of that of any other State Public Service Commission, but not for any other employment either under the Government of India or under the Government of a State.

Article 319 Debate Summary

Draft Article 285C (Article 319 1950 of the Constitution of India) was not included in the draft Constitution 1948. It was introduced by the Chairman of the Drafting Committee on 22 August 1949 to ensure independence of the members of the Public Service Commission from political and professional prejudices. The draft Article barred the chairman and members of the Union and State Public Service Commissions from holding certain positions of employment under the Union and State Governments after serving as members of the Public Service Commission.

A member moved an amendment in the draft Article 285C to replace the word ’employment’ with the word ‘office of profit’. He wanted to limit appointments to positions with monetary benefits that cannot be classified as employment.

Further, he said that no member should be debarred from serving the State in an honorary capacity without any monetary reward. Another member also supported it on the ground that the skills of such members should be used without any restriction. The chairman of the drafting committee responded by saying that the purpose of the draft article is to ensure that the members of the Public Service Commission are independent of executive influence and should not be tempted to hold any honorary post.

One member also proposed that the total period of employment of a member in various Public Service Commissions should not exceed 12 years. It was suggested that the State be prevented from granting preferential treatment to any member by re-appointment to other Public Service Commissions. The members withdrew the above amendments and the assembly adopted the draft Article 285C on the same day.
