The claims of the members of the Scheduled Castes and the Scheduled Tribes shall be taken into consideration, consistently with the maintenance of efficiency of administration, in the making of appointments to services and posts in connection with the affairs of the Union or of a State.

In making appointments to the services and posts in connection with the affairs of the Union or the State, the claims of the members of the Scheduled Castes and the Scheduled Tribes shall be taken into account in accordance with the maintenance of efficiency of administration.

The draft Article 296 (Article 335 of the Constitution of India) was taken up for discussion on 26 August 1949 and 14 October 1949. It states that the union, state or any government body shall consider the representation of minorities as a factor when they make appointments. For posts or services, subject to two conditions: first, the efficiency of administration is maintained and second, the provisions of the draft Article 297 are not violated.

The Assembly first took up this draft article for debate on 24 August 1948. The chairman of the drafting committee wanted to amend this draft article to say that only the claims of the Scheduled Castes and Scheduled Tribes communities should be considered in the appointments. Two minority community members argued that minorities were not consulted regarding this proposed change. They wanted to avoid the debate. The Speaker agreed and insisted that ‘we have always proceeded with their consent in matters relating to minorities’ and proceeded to fix a later date for the debate.

Ambedkar formally introduced the same amendment on 14 October 1948. One member claimed that the motion contradicts the previous decision of the Constituent Assembly and the recommendations of the Consultative Committee. He further said that no justification was provided for the change.

This member proposed an amendment of his own that gave the state the power to extend the benefits of the draft Article to any minority community that it felt was not adequately represented in the government. Another member wanted to bring ‘educationally and socially backward other castes’ within the ambit of this provision.

A member moved the amendment of the Speaker saying that only efficiency should be considered in appointments to public services. However, Parliament will be empowered to list the special considerations that the President may take into account to ensure representation of SC/ST communities.

The Assembly rejected the above proposals and accepted only the amendment of the Chairman of the Drafting Committee. The Assembly adopted the amended draft Article on 14 October 1949. Article 335 was amended in 2000 to allow for laws reducing the requirements or qualifications for members of SC/ST communities in appointments to public services.
