What Is Article 344 Of Indian Constitution?

Article 344 Debate Summary

Draft Article 301B (Article 344 of the Constitution of India 1950) was absent in the draft Constitution 1948. A member of the drafting committee introduced this provision on 12 September 1949. The draft article established a mechanism to evaluate the use of India’s official language. The President shall appoint a commission from time to time with members representing different languages to evaluate the use of Hindi and English as the official languages of the Union. This commission will then make recommendations to a committee consisting of Members of Parliament which will examine the recommendations and submit a report to the President. The President is empowered to issue directions on the basis of the report. This provision was discussed on 12, 13 and 14 September 1949.

A member proposed that the commission should be appointed by the President five years before the commencement of the Constitution. This was to ensure that the Commission could make its recommendations before the expiry of the period of 5 years. Besides this, he also suggested that the committee comprising legislators should be empowered to add their recommendations to the report submitted to the President.

Another member proposed an alternative mechanism consisting of only a committee consisting of members of parliament that would make recommendations to the President. This committee will be constituted within 3 months of the coming into force of the constitution. The President will place the recommendations before the Parliament along with an explanation of the action to be taken. The House rejected these amendments without adequate debate. The draft Article 301B was adopted on 14 September 1949.
