Article 367 Debate Summary

The draft Article 303 (Article 367 of the Constitution of India, 1950) was discussed in the Constituent Assembly on 16 September, 17 September and 14 October 1949. The draft article states that the General Clauses Act 1897 will be used for the interpretation of the Constitution. The Act contained the principles of interpretation and legal definition. The draft article also clarified that an ordinance, passed by the President or the Governor, would fall within the definition of an ‘act’ or ‘law’.

During the debate, the Chairman of the Drafting Committee moved an amendment to add the words ‘applies to the interpretation of an Act of the Legislature of a Dominion of India’.

Two members opposed the amendment. The first pointed out that after the coming into force of the Constitution, the Dominion of India would cease to exist and all laws would become Acts of the Union. The second believed that the essence of the amendment was already contained in the draft article.

The Chairman of the Drafting Committee ignored these arguments and merely said that the amendment was absolutely necessary. The House accepted the amendment without any discussion. The draft Article 303, as a whole, was adopted by the Assembly on the same day.
