Article 38 – State to secure a social order for the promotion of welfare of the people.
(1) The State shall strive to promote the welfare of the people by securing and protecting as effectively as it may a social order in which justice, social, economic and political, shall inform all the institutions of the national life.
(2) The State shall, in particular, strive to minimize the inequalities in income, and endeavor to eliminate inequalities in status, facilities and opportunities, not only amongst individuals but also amongst groups of people residing in different areas or engaged in different vocations.

Article 38 Debate Summary
Draft Article 30 was debated in the Constituent Assembly on 19 November 1948. It directed the state to engage in social change to promote the welfare of Indians. One member wanted to replace the draft article with a provision that directed the state to establish a socialist system and take ownership of, among other things, important sectors of the economy.
It was argued that the prevailing capitalist system was oppressive, and that the only way to secure the welfare of the people was to organize India on socialist lines and this required an explicit mention of ‘socialist democracy’ in the constitutional text. Another member, acknowledging the importance of the article, was concerned about its implementation.
He called for the ‘Instrument of Instruction’ of the Government of India Act 1935 – a set of provisions similar to the Directive Principles of State Policy (DPSPs) in that they were instructions from certain constitutional authorities. He argued that the Act of 1935 had certain provisions to ensure their implementation. On the other hand, there was no such provision in the Indian Constitution; He wanted a ‘higher authority’ to oversee the implementation and take action against violations of the DPSP.
It was clarified that the Constitution, apart from establishing political democracy, also aimed to strive for economic democracy. However, there were many ways in which economic democracy could be achieved – socialism, communism – and the constitution would not specify which path to take. The issue of implementation was not answered here, but was in the previous debate (see article 37 debate summary). The assembly adopted the draft article without any amendment.
