Article 394 Debate Summary
The draft Article 314 (Article 394 1950 of the Constitution of India) was discussed in the Constituent Assembly on 17 October 1949. It indicated the exact date on which the Constitution of India would come into force. However when it was introduced in the assembly, the date was left blank – possibly for the assembly to dispose of.
A member of the Drafting Committee introduced an amendment proposing that the Constitution came into force on 26 January 1950. It appears that 26 January 1950 was chosen to mark the declaration of Purna Swaraj on 26 January 1930 – when Indians first demanded ‘complete independence’. ‘From British rule. Certain provisions relating to citizenship and transition period, however, including draft Article 314, will come into force immediately.
A member wanted that the draft Article 1 and the Preamble be added to those articles which shall come into force with immediate effect. Without these two provisions, there was no point in taking effect of the other provisions. A member of the drafting committee replied that it made sense to apply the Preamble and Article 1 to the entire Constitution.
A member pointed out that the draft Article 311 was a provision with immediate effect. This provision stated that those members of the Constituent Assembly who were elected to the State Legislature would have to give up their Constituent Assembly seats from the date of the commencement of the Constitution. Since this draft article will come into force immediately, will these members immediately vacate their seats, the member asked. A member of the Drafting Committee clarified that this would not happen – all Constituent Assembly members would continue to be members of the Legislative Assembly till 26 January 1950.
The draft Article 314 was adopted by the Assembly on 17 October 1949 and it was decided that the Constitution would come into force on 26 January 1950.
