Article 58 Debate Summary
The Constituent Assembly debated the draft Article 47 (Article 58, Constitution of India, 1950) on 27 December 1948 and 13 October 1949. The draft Article lays down the qualifications required for a person to be elected as the President of India. One member wanted to ensure that a minister who wants to run for the presidency first resigns from his current ministerial office. He argued that this would avoid misuse of the minister’s office and staff for the presidential campaign.
The chairman of the drafting committee highlighted that the amendment would ‘create complete administrative chaos’. If the ministers were to resign, all administrative responsibilities would cease. It would not be possible to assign this role to bureaucrats or temporary ministers. He further said that the Election Commission, a constitutional body, will ensure fair elections and prevent any minister from exerting undue influence.
There was an amendment requiring the President-elect to declare all ‘rights, titles, shares, property and interests’ in any government-aided or supported enterprise, business or trade. Such property was to be purchased by the government. The amendment proponent called for German President Hindenburg’s involvement with the Prussian landowners which strengthened the Nazi government and strongly urged that ‘the president should be free of any entanglements’.
Some members opposed the proposal and argued that it would violate the right to own private property which was a recognized fundamental right. The chairman of the drafting committee observed that the proposal was rather novel and unprecedented: he pointed out how the US Constitution, which adopted the presidential form of government, did not have a similar provision.
Furthermore, this amendment was unnecessary as the Indian Constitution envisaged the position of the President as a ‘nominal figure’. If the assembly adopts it, there will be a shortage of presidential candidates. All fundamental amendments were rejected. On 27 December 1948, the draft Article was adopted with a minor amendment. On 13 October 1949, the Drafting Committee successfully introduced another minor amendment.
