The draft Article 66 (Article 79, Constitution of India, 1950) was debated on 3 January 1949. It determined the composition of the Parliament. A member moved an amendment to remove the ‘Council of States’ from the draft article. He argued that the Council of States, also known as the Second Chambers, was of no use and an old institution. A member of the drafting committee opposed the proposal. He highlighted that the State Council would provide another platform to the people to participate in politics. In addition, it will prevent ‘hasty legislation’.

There was another proposal to replace ‘Parliament’ with ‘Indian National Congress’. The proponents wanted to ‘permanently remember’ the Congress’s participation in the freedom movement and prevent the party from deteriorating in the future. He further mentioned the use of Congress by the US Parliament. A member of the drafting committee did not support the proposal.

He believed that encoding the name of the Congress in the Constitution would lead to a one-party nation. A member demanded the removal of the ‘Chairman’ from the draft article. He called it an ‘unnecessary copying of the British system’. He said that the President is only a decorative head of the nation and should not be an integral part of the legislature.

A member of the drafting committee disagreed with the proposal and argued that the Indian Constitution gave prominence to the President—he was the acting head of the nation. It was important to include the president in the legislature. None of these proposals was accepted. The Assembly adopted the draft Article without amendment on 3 January 1949.
