Article 96 Of Indian Constitution In English

Article 96 – The Speaker or the Deputy Speaker not to preside while a resolution for his removal from office is under consideration.
(1) At any sitting of the House of the People, while any resolution for the removal of the Speaker from his office is under consideration, the Speaker, or while any resolution for the removal of the Deputy Speaker from his office is under consideration, the Deputy Speaker, shall not, though he is present, preside, and the provisions of clause. ( 2 ) of Article 95 shall apply in relation to every such sitting as they apply in relation to a sitting from which the Speaker, or, as the case may be, the Deputy Speaker, is absent.

(2) The Speaker shall have the right to speak in, and otherwise to take part in the proceedings of, the House of the People while any resolution for his removal from office is under consideration in the House and shall, notwithstanding anything in Article 100, be entitled to vote only in the first instance on such resolution or on any other matter during such proceedings but not in the case of an equality of votes.

96 Article – The Speaker or the Vice-President should not preside while a motion for removal from his office is under consideration.
(1) The Deputy Speaker, though present, shall not preside at any sitting of the House of the People while a motion for the removal of the Speaker from his office is under consideration, or when a motion for the removal of the Deputy Speaker from his office is under consideration, and clause will not. (2) Article 95 shall apply in relation to every such meeting as they apply in relation to a meeting from which the Chairman, or the Vice-Chairman, as the case may be, is absent.
(2) The Speaker shall have the right to speak in the House of the People and otherwise take part in the proceedings of the House while a motion for his removal from office is under consideration in the House and notwithstanding anything contained in article 100, during such proceedings such resolution or shall be entitled to vote on any other matter only in the first instance, but not in the case of equality of votes.

Draft Article 78-A was discussed on 19 May 1949. This was not a part of the initial draft Constitution, 1948. The drafting committee introduced it as an amendment. It barred the Speaker and the Deputy Speaker of the Lok Sabha from presiding over the meetings dealing with any motion seeking their removal. A member of the drafting committee introduced the provision and said that the draft was in line with Article 75-A. There was no further debate. The Constituent Assembly adopted the draft article on 19 May 1949.
