Article 70 Debate Summary
Draft Article 57 (Article 70, Constitution of India 1950) was debated on 29 December 1948. It gave residuary powers to the President to discharge his functions. There was no real debate surrounding the draft article. One member did not want the President to have these residuary powers. Instead, he wanted Parliament to regulate his practice.
He demanded to apply this provision to the Vice President as well. The Chairman of the Drafting Committee said that the Constitution specifically mentions the role of the Vice President as the Chairman of the Council of States. In the absence of the Vice-President, the Constitution also provides for a Deputy Speaker. Therefore the amendment was not necessary. On 29 December 1948, the assembly adopted the draft article without any amendment.
