Article 67 – Term of office of Vice President.
The Vice President shall hold office for a term of five years from the date on which he enters upon his office: Provided that.
(a) a Vice President may, by writing under his hand addressed to the President, resign his office;

(b) a Vice President may be removed from his office by a resolution of the council of States passed by a majority of all the then members of the council and agreed to by the House of the People; but no resolution for the purpose of this clause shall be moved unless at least fourteen days notice has been given of the intention to move the reso.
(c) a Vice President shall, notwithstanding the expiration of his term, continue to hold office until his successor enters upon his office.

The draft Article 56 (Article 67, Constitution of India 1950) was discussed on 29 December 1948. It determined the term of office of the Vice President. It was proposed to specify emoluments including salary, residential and post-retirement benefits of Rs 4500 per month. The mover argued that if the President’s residential benefits have been prescribed in the Constitution, similar provisions should be made for the Vice President.

In addition, the post-retirement benefits will ensure that candidates from economically disadvantaged backgrounds are provided with equal opportunities to compete in the vice-presidential elections. One member wanted to include the grounds of disqualification including violation of the constitution, punishment for offences, mental incapacity and corruption.

The Chairman of the Drafting Committee responded by highlighting that the ‘lack of confidence’ in clause B contained the grounds outlined in the member’s amendment—there was no need to specifically mention it in the Constitution. Another member sought clarity with regard to the removal of the Vice President. The draft Article did not specify the majority required to remove the Vice President.

Furthermore, the member was surprised by the process of removing the Vice President being more stringent than that of the President. Removal of the Vice-President requires a resolution passed by both houses of Parliament, but only one is required for the President. A member introduced an amendment that would require a 2/3 majority from both houses of Parliament to remove the Vice-President.

He stressed that since the role of the Vice President is important, his removal should not be accidental. The Chairman of the Drafting Committee pointed out that the primary role of the Vice President is as the Chairman of the Council of States. Hence his removal procedure is similar to that of Speaker of Lok Sabha – there was no need for 2/3 majority. The assembly accepted the draft article without any amendment.
