Article 57 Debate Summary
The draft Article 46 (Article 57, Constitution of India, 1950) allows for the re-election of the President. This article was debated on 13 December 1948. The draft article restricted the re-election of the President in its former form: a person could serve as the President of India for only one term. A member moved an amendment to remove this restriction.
He said that a ‘competent and efficient person’ should be allowed to render his services to the country as long as he is capable. Another proposal was to ensure that a president who had been impeached should be barred from being re-elected. The proponent of this resolution cited foreign experiences of how a president impeached on corruption and other ‘nefarious’ grounds was re-elected.
He said: ‘Given that the public memory is so short and even the memory of the party is so short’, a previously impeached president is likely to be nominated for re-election. The Chairman of the Drafting Committee believed that the issue could be considered during the discussion on the qualifications of the President. The amendment was withdrawn. The assembly voted in favor of lifting the outright ban for re-election. It adopted the draft article with amendments.
