The draft article received widespread support. For much of colonial India, the judicial and executive wings of administration were intertwined – Indians felt this compromised judicial independence. The members of the assembly pointed out that the separation of the executive and the judiciary was a long-standing demand of the freedom movement. This demand was made in the first meeting of the Congress in 1885 and after that in several resolutions of the Congress.

One member was reluctant to support the article. He suggested that the secession principle was important in the context of a foreign government, but was not sure of its prominence in independent India. He was concerned that the draft Article would, in practice, confer undue power to the judiciary leading to judicial overreach. In response, another member argued that judicial independence was far more important with ‘the advent of democracy and liberty’.

The three-year deadline of the draft article did not go down well with the assembly. Members felt that the Directive Principles of State Policy should mention only broad principles and should not go into the details of implementation like timelines; Then an amendment was introduced to remove the three-year time limit. At the end of the debate, the assembly adopted the draft article with amendments
