What Is Article 44 Of Indian Constitution?
Article 44 Debate Summary
The Constituent Assembly took up the draft Article 35 for debate on 23 November 1948. As the text of the draft article suggests, it directed the state to bring in a uniform civil code across India. The debate surrounding the draft article sparked controversy. The draft article was mostly opposed by Muslim members who introduced amendments to keep personal law out of the purview of the draft article and introduced a provision that made the draft article operated only with the prior consent of the community.
Arguments used to attack the draft article include: first, that the Uniform Civil Code violated freedom of religion; second, the draft article will create animosity within the Muslim community and third; It was wrong to interfere in personal law without the approval of religious communities. The draft article received support. The members argued that the UCC was important for maintaining the unity of the country and the secular credentials of the Constitution.
UCC Full Form – Uniform Civil Code
One member reminded Muslim members that this is not a provision that would affect the Muslim community alone – even the Hindu community would have to deal with it. It was further added that women’s rights can never be secured without UCC. At the same time, the argument that the UCC would violate religious freedom under the constitution was rejected – the constitution gave room for social reform legislation. At the end of the debate, it was clarified that there was nothing new about the UCC: India already had a uniform civil code.
The only difference with the new UCC was that it would cover marriage and inheritance – which were not within the scope of the existing code. It was also pointed out that the UCC was a directive principle, the state was not bound to implement this provision immediately and there was room for the consent of the communities to be obtained.
