Article 52 Debate Summary
Draft Article 41, Part V – The inaugural provision of the Union was discussed in the Constituent Assembly on 10 December 1948. It only said that India would have a President. The article proposed to include the description of the President as ‘Chief Executive and Head of State’. The members who supported this resolution argued that it would elevate the position of the President and indicate that the sovereignty of the people was vested in him.
However, other members said that the motion was inappropriate as it suggested a presidential system of government, although the draft constitution adopted a parliamentary system. Another member wanted to know why the word ‘President’, which was present in earlier versions of the draft Article, was dropped and whether it was a result of negative attitude towards Hindi.
It was clarified that the word was dropped as the Hindi version of the draft Constitution was being prepared and that ‘President’ could be used there. At the end of the debate, the assembly adopted the draft article without amendment.
