Article 106 – Salaries and allowances of members.
Members of either House of Parliament shall be entitled to receive such salaries and allowances as may from time to time be determined by Parliament by law and, until provision in that in that respect is so made, allowances at such rates and upon such conditions as were immediately before the commencement of this Constitution applicable in the case of members of the Constituent Assembly of the Dominion of India Legislative Procedure.

Article 106 Debate Summary
Draft Article 86 (Article 106, Constitution of India, 1950) was discussed on 20 May 1949. This enabled the Parliament to regulate the salaries and allowances of the members of the Parliament. A member introduced an amendment that would provide the Leader of the Opposition with the same salary as a minister without cabinet rank.
It will constitutionally recognize the Leader of the Opposition and promote ‘Parliamentary Opposition’ which is a shield of democracy. Moreover, conditions should not be created to promote only one party government in the form of parliamentary democracy. The explicit recognition of the opposition in the constitution would prevent the dominance of one party and create favorable conditions for criticizing the government.
Another member supported the amendment and believed that the statutory recognition of the Leader of the Opposition would be important for the effective functioning of a democracy. Many members opposed this amendment. It was pointed out that the Constitution did not prohibit the Parliament from paying salaries to the Leader of the Opposition.
The future Parliament was also empowered to fix the salary and allowances of the Leader of the Opposition. It was not required to be explicitly mentioned in the Constitution. Another member upheld the draft article, saying it was ‘detailed’ enough to include the salary of the Leader of the Opposition.
Furthermore, no other constitution had codified the salary of the Leader of the Opposition in its text. The same member further proposed fixing the ratio between the salaries of members of parliament and ministers, a practice that can be found in Australia and New Zealand. This amendment will remove the wide class disparity between ministers and other members. The Assembly did not accept these amendments. It adopted the draft article on 20 May 1949.
